Privacy Policy

MVMT.Studio (Sunset Mind Lda.) is committed to protecting the privacy of its members by handling personal information in accordance with applicable laws, including the GDPR. The Studio collects personal information (name, birth date, address, phone, email), any relevant health information shared to help us support your movement practice safely and effectively, payment data (credit/debit card info), and usage data regarding facility use. This information is used for managing memberships, processing payments, communicating about news and events, health assessments, and complying with legal obligations.

The legal basis for processing these data includes client consent, contractual obligations, and legal compliance. The Studio does not sell or rent personal information but may share it with service providers and legal authorities when required. Appropriate security measures are in place to protect client information from unauthorized access or loss. Clients have rights concerning their data, including access, correction, deletion, restriction, and portability. The Studio reserves the right to update this policy, with significant changes communicated to clients. Terms & Conditions

The following terms apply to all services offered at MVMT Studio that are accessed using class packs, including but not limited to movement classes, recovery sessions (cold plunge & sauna),workshops, and special events.

Schedule & Instructor Changes

While we aim to maintain our published schedule, MVMT Studio reserves the right to make changes or cancellations without prior notice.

Teachers and facilitators may be substituted at any time without notice.

Pricing

Class credits. 1 credit for 25€. 5 credits for 95€.

Recovery room and functional area credits. 1 credit for 15€. 5 credits for 60€. Recovery credits are 30% off while you hold an active class pack.

Bookings & Payments Class packs and recovery and functional packs are valid only for the duration and services specified at the time of purchase. The duration changes according to the amount of credits bought: 1 month for 1 credit and 3 months for 5 credits.

All bookings must be made online via our website or in person at the studio.

Credits must be used within the validity period of your pack. Unused credits will not be extended or refunded.

All clients must check-in before class

Class credits are to be used exclusively for classes, while recovery and functional area credits are for exclusive use in the recovery room or functional area. It is not possible to use one type of credit in the space designated for the other.

Following the purchase of a credit or package, clients are entitled to a 14-day period to request a refund, provided that, in the case of packages, no credits have been utilized.

Late Entry Policy

For the respect of other participants and the flow of the class, entry may be refused if you arrive more than 5 minutes after the scheduled start time.

Cancellations & No-Shows

You may cancel your booking up to 4 hours before the class start time without penalty.

Late cancellations or no-shows will result in the deduction of a class credit or a 8€ fee for members for late cancellations and 10€ for no-shows.

Lost objects

You are responsible for your personal belongings and any lost property and personal objects will be kept in the “lost and found” for 1 week.

Class Pack Validity

Packs are personal and non-transferable. Sharing packs may result in cancellation without refund.

Class packs are non-refundable and cannot be paused or extended unless a medical certificate is provided.

Introductory Offers

Intro packs are limited to one per person. Misuse of offers may result in cancellation of access without refund.

Studio Use & Etiquette

Please respect the space, team, and other members. Clean up after use and be mindful in shared areas.

The studio reserves the right to refuse service to any individual in case of inappropriate behavior or for the wellbeing of the community.

Liability

By attending any session, you confirm that you are physically fit and capable of participating in movement and recovery activities. MVMT Studio is not liable for injuries sustained during class, unless due to proven negligence.

You understand and accept that participation is at your own risk.

Special Events & Workshops

Class packs do not include access to guest teacher sessions, workshops, or specialevents unless explicitly stated.

Separate bookings and payments are required for these offerings.

Studio Closure

MVMT Studio may close temporarily for maintenance, holidays, or unforeseen circumstances. In such cases, valid packs may be extended accordingly at the studio’s discretion.

Agreement

By purchasing a class pack and/or booking a class at MVMT Studio, you agree to these Terms & Conditions.

Terms & Conditions Memberships

1. Object & Agreement

1.1. Scope: These Terms & Conditions govern the membership, access, and use of facilities, equipment, and services provided by MVMT Studio ("Studio").

1.2. Agreement: The contract is executed when the Member registers on the official booking platform (Momence) and accepts these Terms.

1.3. Minors: Memberships are available to individuals aged 16 and older. Individuals aged 16 or below require the consent from a parent or legal guardian.

2. Studio Access & Rules

2.1. Operating Hours: Operating hours are determined by the Studio and may be updated periodically. Updated schedules will be published via official channels.

2.2. Personal & Non-Transferable: Memberships and class bookings are personal and non-transferable. Account sharing or transferring bookings may result in immediate account suspension.

2.3. Independent Services: Members may access services provided by independent third-party professionals accredited by the Studio, subject to their specific terms and rates.

3. Memberships details

3.1.Traveller: Unlimited classes and Recovery/Functional sessions (up to 3 classes and 2 Recovery/Functional bookings per day).

3.2. Deep Dive: 12 class credits and 8 Recovery/Functional credits per month.

3.3. Flow: 8 class credits and 5 Recovery/Functional credits per month.

3.4. Kids Membership: 1 or 2 classes per week (as selected).

3.1.5. Intro Offers: Introductory packages are subject to specific durations and pricing detailed at purchase on Momence, following the general rules of Unlimited memberships.

3.5. Billing Options: Memberships are billed on a recurring basis (monthly, every 3 months, or every 6 months) as selected and agreed upon enrollment.

4. Member Duties Members agree to

4.1. Accurate Information: Provide and maintain complete, accurate, and up-to-date profile and payment information on Momence.

4.2. Rules & Conduct: Follow instructions from Studio staff and maintain respectful behavior toward staff, instructors, and other members at all times.

4.3. Valid Payment Methods: Keep a valid credit card on file to maintain an active membership status.

5. Payments, Fees & Pricing

5.1. Dues: Members agree to pay all applicable membership fees regardless of actual facility utilization.

5.2. Invoicing: To receive tax invoices containing a VAT number (NIF), members must email hello@mvmtstudio.space with their details.

5.3. Price Adjustments: The Studio reserves the right to review membership pricing annually (typically in January). Price updates occurring outside this period will be communicated with at least 30 days' advance notice.

5.4. Failed Payments: If a payment fails due to member error or insufficient funds, a processing fee may be charged for each retry attempt.

5.5. Late Cancellation & No-Show Policy: Late Cancellation Fee: €8 if a class is canceled less than 4 hours before its scheduled start time. No-Show Fee: €10 for unexcused non-attendance. For credit-based memberships, the credit is also forfeited.

6. Membership Pause (Freezing)

6.1. Eligible Plans: Pausing is available for memberships with 3 or 6 months durations. Monthly membership or PAcks do not offer a pausing period.

6.2. Pause Terms: 3 months membership may pause for a period of 2 weeks. 6 month memberships may pause for a period of 4 weeks.

6.3. Request Procedure: Pause requests must be submitted to hello@mvmtstudio.space with at least 15 days' notice. Bookings and access are disabled during the pause period.

7. Contract Termination & Cancellation

7.1. Member Non-Renewal / Cancellation: Members may cancel or oppose contract renewal by submitting a written request to hello@mvmtstudio.space at least 15 days prior to their next billing date. Payments already processed are non-refundable.

7.2. Right of Withdrawal (Cooling-off Period): Under Portuguese Law, members purchasing online have 14 calendar days from the purchase date to withdraw from the contract without penalty by emailing hello@mvmtstudio.space. If services or facilities were used during these 14 days, a proportional amount corresponding to the consumed services will be deducted from the refund.

7.3. Contract Changes: If the Studio modifies these Terms or pricing outside the annual review, members who do not agree may terminate their membership prior to the changes taking effect.

7.4. Termination by the Studio: The Studio may terminate a membership with 30 days' written notice, or immediately in cases of material breach, including: Non-payment exceeding 30 days; Serious misconduct, property damage, or safety violations; Granting unauthorized facility access to third parties; Providing false or fraudulent personal information.

8. Force Majeure & Limitation of Liability

8.1. Force Majeure: The Studio is not liable for temporary service interruptions caused by events beyond its control (e.g., government restrictions, severe weather, emergency maintenance). Interruptions under 30 days do not entitle members to fee reductions or refunds. If an interruption exceeds 30 consecutive days, either party may cancel the contract.

8.2. Liability: The Studio's liability is limited to cases of willful misconduct or gross negligence, in accordance with applicable Portuguese law. Members are responsible for their own health suitability when participating in physical activities.

9. General Provisions

9.1. Official Communications: Official notices, cancellation requests, or legal notifications must be sent in writing to hello@mvmtstudio.space or via the Studio’s official WhatsApp channel.

9.2. Applicable Law & Jurisdiction: This agreement is governed by Portuguese Law. Any disputes arising from or related to this contract shall be submitted to the District Court of Lisbon (Comarca de Lisboa).

9.3.
